Terms & Conditions

1.         Introduction

1.1       These are the terms and conditions (T&C’s) [in general] by which Lomac Aviators Ltd trade.

1.2       References in our T&C’s and website such as “we, us, our” refer to Lomac Flying Club. Our trading address is: – Lomac Aviators Ltd, GA Apron, Viscount Drive, Liverpool, L24 5GA. 

1.3     By submitting an application/membership form to us for enrolment on a Course or to become a self-fly member, (as set out below), you acknowledge and agree that these Terms and Conditions will become legally binding on you.

1.4    In respect of self-fly lease or any other of our services offered on our website and in any other literature, you acknowledge and agree that these Terms and Conditions will become legally binding on you at the time you make the booking with us either by telephone or email.

1.5    In the event of any conflicts or inconsistencies between these Terms and Conditions and any other documents pertaining to your membership/enrolment/ participation on either a course (as a student) or leasing an aircraft (as a self-fly) [as defined below], or any other of our services on offer [as the case may be] including any brochures, advertising material, descriptions on our website, these Terms and Conditions shall prevail.

2.      Definitions

2.1    Aircraft means one of the aircraft owned or leased by us and used on a Course or made available by us for self-fly hire.

2.2   CAA means the UK Civil Aviation Authority or any replacement or successor body.

2.3   Course means any pilot training or related course offered and provided by Lomac Aviators Ltd from time to time.

2.4   EASA means the European Aviation Safety Agency or any replacement or successor body.

2.5   Lease means a person making a self-fly booking.

2.6   Pilot in Command means the person aboard the Aircraft who is ultimately responsible for its operation and safety during the flight.

2.7   Premises means Lomac Aviators Ltd, GA Apron, Viscount drive, Liverpool, L24 5GA.

2.8   Student means any person accepted by us on a Course.

2.9  Club means Lomac Aviators Ltd.

3.         General Terms of Business

3.1       Flight times quoted are approximate and may vary due to volume of air traffic or other operational reasons at the Airport and Flying School. Flight time includes airborne time plus 15 minutes for taxi and check [10 before and 5 after] for training; and 10 minutes for taxi and check [5 before and 5 after] for self-fly.

3.2       Students under the age of 18 require the written consent of a parent or guardian [ the membership form will be signed by a parent or guardian]. Parents or guardians must ensure that all children are properly supervised at all times.

3.3       Observers on (4 Seater) flights are restricted to family or friends of the Student and are welcomed aboard at the discretion of the Flight Instructor.

3.4       All flights are subject to cancellation by the Company at short notice. It is the responsibility of     the Student to telephone the Company on 0151 907 1414 on the morning of their flight to confirm arrangements.  The Company will not be liable for any associated cost resulting from a cancellation at short notice. It is the responsibility of the Student/self-fly/member to book their appointment using telephone or email and it is also their responsibly to attend at the said time. 

3.5      If the student/self-fly/member dose not turn up for the planned/booked flight and does not give the appropriate notice of cancelation [24 hours], a cancelation fee of £35.00 will be invoice to the said student/self-fly.

3.6      In the event of a booking being cancelled by the Club due to operational circumstances or any   circumstances outside of its control the purchased goods/service remain valid, subject to the relevant validity period if booked using a pre-paid voucher, and may be rebooked for a mutually convenient date.

3.7     Lomac Aviators Ltd will not be liable for any expenses or costs incurred from flight cancellation due to operational circumstances or any circumstances outside of its control.

3.8      Height and Strict weight restrictions apply – please contact the Club before your flight if above 15 Stone/95.25kg.

3.9       Purchased goods and services [courses and money on account] are non-refundable and non-transferable. 

3.10     All pre-paid goods and services, including gift vouchers, Courses and lessons, must be claimed and used within 6 months unless specified otherwise. The validity of expired goods and services may be extended subject to an additional charge and at the sole discretion of Lomac Aviators Ltd.

3.11    All students and self-flyers must maintain a valid Club membership to fly.  If the student or self-flyer maintains an account with the club the account must remain in credit at all times.

3.12   If in the opinion of the Company/Staff it considers the aptitude, behaviour or attitude of a student/self-flyer/member falls below that expected of a student/self-flyer/member or the student/self-flyer/member breaches the operations manual or standard operating procedures or the student/self-flyer/member fails to maintain their account in credit, the Company may  cancel a flight or a Course at its sole discretion and terminate the membership of a student/self-flyer/member.  Any refund, in full or in part, will be at the sole discretion of the Company.

3.13   All student/self-flyer/member should ensure that they are in good health and if in doubt should seek medical advice from their doctor. This is the responsibility of the Student.

3.15   The Flight Instructor reserves the right to refuse to allow any person or persons on board the aircraft if they [flight instructor] suspects the person or persons to be under the influence of alcohol or drugs, or if they [flight instructor] feels they may adversely affect the safe conduct of the flight in any way.  No refund will be offered in such circumstances.

3.16   When airside, visitors shall stay with their escort at all times and are subject to, and will comply   with, all current safety rules and procedures.

3.17   Whilst every precaution is taken for the safety of student/self-flyer/member/visitor and their property, the Company will not be held liable for any loss, theft, damage or, as far as permitted, injury.

3.18   The Company has a no smoker rule (real or electronic) and once inside the security perimeter     “no smoking” is allowed.

3.19   All pilots in command of Company aircrafts (student/self-flyer/member) must: –

(a) certify their understanding and acceptance of all required Company manuals and documentation before undertaking any flight as commander of a Company aircraft, unless the same has been signed within the last 12 months or since the last amendment, whichever is the latter.

(b) comply with all rules and procedures as set out therein; and furthermore.

(c) comply with these terms and conditions at all times.

3.20    These terms and conditions are governed in accordance with the laws of England & Wales.
